Terms of service.
What you're agreeing to when you buy a website from me. Written in English, not legal speak, but still legally binding.
1. What you're buying
The $999 Contractor Site Design package is a fixed-scope website build with the following deliverables:
- One 5-page WordPress website
- Three template layouts to choose from (you pick one)
- Mobile-responsive design
- Contact form connected to your email
- Basic on-page SEO (title tags, meta descriptions, H1 tags, alt text)
- SSL certificate setup
- One revision round after initial build
- Written handoff document
- Launch of the site on your domain
Delivery target is 5 business days from the date I receive your complete content. "Complete content" means all information requested on the intake form has been submitted.
What's not included: custom design from scratch, copywriting, logo design, photo sourcing, blog setup, e-commerce systems, booking systems, multiple revision rounds, ongoing SEO work, advertising management, or any service not explicitly listed above. These are available as separate add-ons or through my premium agency Primate Web FX.
2. Payment
Full payment of $999 is due upfront at the time of order, processed through Square. No partial payments, no payment plans, no exceptions for the base package.
Additional services (extra pages at $99 each, add-ons, second revision rounds, etc.) are billed separately and must be paid before that work begins.
Ongoing services (hosting at $29/month, annual tune-ups at $199/year) are billed separately on a recurring basis and can be canceled at any time. Cancellation takes effect at the end of the current billing period.
3. Refunds
Refund eligibility depends on where we are in the process:
- Before build starts: Full refund, no questions asked. "Build starts" means the day I begin customizing your chosen template with your content.
- After build has started: No refunds. The work is already being done. If you decide mid-build that you want to stop, the site will be delivered in whatever state it's in at the time of cancellation.
- After launch: No refunds on the $999 build fee. If a defect exists in the delivered work (meaning something I built doesn't function as described), I'll fix it free within 30 days of launch.
If you change your mind and want a refund before build starts, contact me through the Start page form. Refunds are processed back through Square within 5 business days.
4. Your responsibilities
For this service to work, you have to hold up your end:
- Provide content promptly. Fill out the intake form with your business info, services, phone, hours, photos, and template choice. If content isn't complete within 14 days of payment, your project is paused and goes to the back of the build queue.
- Consolidate revisions. After the preview link goes out, you have 5 business days to send ONE email with all your change requests. Not 3 emails over 3 days.
- Own the rights to anything you submit. Photos, text, logos, branding — you confirm you own these or have permission to use them. If you submit stolen or infringing content, I'm not liable and you'll need to remove or replace it.
- Provide accurate business information. If your business isn't really licensed/insured/certified and I put that on your site because you told me to, that's on you.
- Comply with applicable laws. Your content and business must comply with the laws of the jurisdictions you operate in.
5. Ownership of the website
Once the site is launched and paid for, you own:
- Your domain name (if you registered it through me, it's in your name from day one)
- The WordPress installation, files, and database
- All content I wrote or customized specifically for your site
- All images I sourced or created for your site (where I have the right to transfer them)
- The full right to modify, move, transfer, or take the site elsewhere at any time
I retain the right to reference the work in a portfolio (unless you specifically request otherwise, which I'll honor without extra charge).
The three template layouts themselves remain my intellectual property. You get a perpetual, royalty-free license to use the template as customized for your business, but you can't resell the template, redistribute it, or claim authorship of the layout design itself.
6. Plugin licensing
Your website uses commercial WordPress plugins. Currently these are:
- Beaver Builder (page builder)
- Beaver Themer (header and footer builder)
- PowerPack for Beaver Builder (additional modules)
- Fluent Forms Pro (contact and intake forms)
License keys for these plugins are owned and managed by Contractor Site Design. They are provided to your site at no additional charge as part of the Hosting & Care Plan ($29/month).
If you cancel the Hosting & Care Plan:
1. You have a 30-day transition window to either purchase your own licenses directly from the plugin vendors, or accept that the plugins will continue to function without updates.
2. After 30 days, my license keys will be deactivated from your site. The plugins will keep working but won't receive security updates or new features until you install your own licenses.
3. I'll provide a list of plugins used and direct purchase links at no charge upon request. Estimated annual cost if you purchase independently: approximately $300 USD.
4. All plugin source code and your site's specific configurations remain yours under WordPress's GPL licensing.
This is how the $999 price stays $999. Bundling licenses with hosting lets everyone save money. You're never locked in, but you're never forced to buy a license stack you don't need either.
7. Scope changes
This is a fixed-scope, fixed-price offer. That's how $999 works. If you ask for things beyond the listed deliverables during or after the build, those are treated as additions:
- Extra pages beyond the 5 included: $99 per page
- Additional revision round after the first: $150
- Copywriting (if you don't provide content): $150 per page
- Logo design: $199 (simple wordmark) or $399 (custom design)
- Blog setup: $299
- E-commerce or booking systems: quoted separately, typically starts at $1,500
All add-ons are quoted, agreed to in writing (email is fine), and paid before the work begins. I don't start work on scope additions without written approval and payment.
8. Hosting & Care Plan
The optional Hosting & Care Plan ($29/month) includes:
- WordPress hosting on SiteGround (or equivalent)
- Daily backups with 30-day retention
- SSL certificate management
- Plugin licenses for commercial plugins used on your site
- WordPress core and plugin security updates
- Up to 30 minutes per month of minor content updates (phone number changes, adding hours, text edits)
- Email support with 24-hour response time on business days
Not included in the monthly plan: new pages, major redesigns, new functionality, SEO work, ad management, or anything that takes more than 30 minutes. Those are billed separately at $95/hour or as flat-fee add-ons.
You can cancel the Hosting & Care Plan at any time. Cancellation takes effect at the end of the current billing period. See Section 6 for what happens to plugin licenses.
9. Warranty and limits of liability
I stand behind my work. For 30 days after launch, if anything I built doesn't function as described, I'll fix it free. After that, bug fixes are either covered under your care plan or billed as support requests.
Beyond that 30-day warranty, the service is provided "as-is." I can't guarantee that your website will generate leads, rank on Google, attract customers, or make you money. No reputable web designer can guarantee that. Too many factors outside my control affect those outcomes.
To the maximum extent permitted by law, Contractor Site Design's total liability for any claim arising out of this agreement is limited to the amount you paid me. If you paid $999, my maximum liability is $999.
I'm not liable for:
- Indirect, incidental, or consequential damages
- Lost profits, lost business, or lost data
- Downtime caused by hosting providers, plugin vendors, or other third parties
- Security breaches that result from your own actions (weak passwords, falling for phishing, sharing credentials)
- Content you provided being wrong, infringing, or illegal
10. Termination
Either party can end the relationship at any time:
- You can cancel before build starts for a full refund. During or after build, you can stop using my services but refunds aren't available (see Section 3).
- I can cancel if you're abusive, if you're using the service for illegal purposes, if your business activities violate laws or platform policies (Square, WordPress, etc.), or if you haven't paid.
If I cancel mid-build for abusive behavior or illegal activity, no refund is due. If I cancel for any other reason, I'll refund the portion of the work not completed.
11. Governing law and dispute resolution
These terms are governed by the laws of the Province of Manitoba, Canada. Any dispute arising out of or related to these terms or the services provided will be resolved in the courts of Manitoba, unless we both agree in writing to arbitrate or mediate.
If you're outside Manitoba, you agree that Manitoba is the appropriate jurisdiction and waive any objection based on inconvenient forum. Before taking legal action, you agree to contact me and attempt to resolve the issue in good faith for at least 30 days.
If any part of these terms is found unenforceable, the rest still applies.
12. Changes to these terms
I can update these terms. If I do, the "Last updated" date at the top changes. For material changes, I'll notify existing clients by email. Continued use of the service after changes means you accept the new terms.
The terms in effect at the time you purchased govern that purchase. If you bought a website under these 2026 terms, these 2026 terms apply to your project even if I update the terms later.
13. Contact
For questions about these terms, dispute resolution, cancellations, or anything else legal: use the Start page form with "Legal" in the subject line. I'll reply within 24 hours on business days.
One last thing
These terms exist because every professional service needs clear rules. I'm not trying to trap you, protect myself from everything, or sneak anything past you.
If something in here doesn't make sense, ask. Before you buy is better than after. I'd rather explain my process clearly than end up in a dispute over a detail I assumed you understood.
